We are doing business as PopCamps ("Company," "we," "us," "our"). We operate the website https://popcamps.one (the "Site"). PopCamps is a summer camp directory that helps parents in Washington state discover and explore local summer camp programs for children. Parents can search camps by location, age range, and date. Camp operators can submit or claim their listing to keep it up to date. We do not sell products or process payments.

These Legal Terms constitute a legally binding agreement. The Services are intended for users who are at least 18 years old.
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. The Services are not designed to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA.
Our intellectual property. We own or are licensed to use all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services, as well as all trademarks, service marks, and logos. This content is provided "AS IS" for your personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. Your submissions and contributions. By posting content to the Services, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to use that content in any manner. You are responsible for what you post. We may remove or edit any content at any time.
By using the Services, you represent that: (1) all registration information you submit is true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to agree to these Terms; (4) you are not a minor; (5) you will not access the Services through automated means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use will not violate any applicable law or regulation. Providing false information may result in suspension or termination of your account.
You may be required to register to use certain features. You agree to keep your password confidential and are responsible for all activity under your account. We reserve the right to remove, reclaim, or change usernames we deem inappropriate.

By posting Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to host, use, copy, reproduce, disclose, sell, publish, broadcast, archive, store, publicly display, reformat, translate, transmit, excerpt, and distribute your Contributions in any form or media. You retain ownership of your Contributions. We have the right to edit, redact, re-categorize, or delete Contributions at any time. We have no obligation to monitor user Contributions.
The Services may contain links to third-party websites. We do not investigate, monitor, or check third-party websites for accuracy. We are not responsible for the content or practices of any third-party websites. Inclusion of a link does not imply our endorsement. You access third-party websites at your own risk. We are not responsible for any purchases made through third-party websites.
We reserve the right to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict, or disable any of your Contributions; (4) remove files that are excessive in size or otherwise burdensome; and (5) otherwise manage the Services in a manner designed to protect our rights and facilitate their proper functioning.

Note that a copy of your notification may be sent to the person who posted the material. You may be liable for damages if you make misrepresentations in your notification.
These Legal Terms remain in full force while you use the Services. WE RESERVE THE RIGHT TO DENY ACCESS TO AND USE OF THE SERVICES, INCLUDING BLOCKING CERTAIN IP ADDRESSES, TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT IN THESE LEGAL TERMS, WITHOUT NOTICE OR LIABILITY. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AND ANY CONTENT YOU POSTED AT ANY TIME, WITHOUT WARNING.
If we terminate or suspend your account, you are prohibited from registering a new account under your name or a false name. We reserve the right to take appropriate legal action, including civil, criminal, and injunctive redress.
We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We have no obligation to update any information on the Services. We cannot guarantee the Services will be available at all times. There may be hardware, software, or maintenance issues that result in interruptions or errors. We reserve the right to modify or discontinue the Services at any time without notice or liability. We are not liable for any inconvenience or damage caused by inability to access the Services.
These Legal Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
Informal Negotiations. To expedite resolution and reduce costs, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration. Informal negotiations begin upon written notice from one party to the other.
Binding Arbitration. If a dispute cannot be resolved through informal negotiations, it shall be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), including AAA's Supplementary Procedures for Consumer Related Disputes. Arbitration fees are governed by the AAA Consumer Rules. If costs are deemed excessive, we will pay all arbitration fees. Arbitration may be conducted in person, by documents, by phone, or online. The arbitrator shall make a written decision. Arbitration takes place in King County, Washington. Either party may litigate in court to compel arbitration, stay proceedings pending arbitration, or confirm, modify, vacate, or enter judgment on the award. If arbitration is not required, disputes shall be resolved in state or federal courts located in King County, Washington. The UN Convention on International Sale of Goods and UCITA are excluded.
Restrictions. Arbitration is limited to the dispute between the parties individually. No class-action or representative-capacity arbitration is permitted.
Exceptions. The following are not subject to arbitration: (a) disputes seeking to enforce or protect intellectual property rights; (b) disputes related to theft, piracy, invasion of privacy, or unauthorized use; (c) claims for injunctive relief.
The Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time without prior notice.
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT. WE ARE NOT LIABLE FOR: (1) ERRORS OR INACCURACIES IN CONTENT; (2) PERSONAL INJURY OR PROPERTY DAMAGE; (3) UNAUTHORIZED ACCESS TO OUR SERVERS OR YOUR PERSONAL OR FINANCIAL INFORMATION; (4) INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; (5) BUGS, VIRUSES, OR TROJAN HORSES TRANSMITTED THROUGH THE SERVICES; OR (6) ERRORS OR OMISSIONS IN ANY CONTENT. WE DO NOT ENDORSE THIRD-PARTY PRODUCTS OR SERVICES AND ARE NOT RESPONSIBLE FOR MONITORING TRANSACTIONS BETWEEN YOU AND THIRD-PARTY PROVIDERS.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID TO US. CERTAIN STATE LAWS MAY NOT ALLOW THESE LIMITATIONS, SO SOME DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, from any loss, damage, liability, or claim (including attorneys' fees) arising from: (1) your Contributions; (2) your use of the Services; (3) any breach of these Legal Terms; (4) breach of your representations and warranties; (5) violation of any third-party rights, including intellectual property rights; or (6) any harmful act toward another user. We reserve the right to assume exclusive defense of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims, and we will notify you of any such claim.
We may maintain certain data you transmit to the Services for the purpose of managing the Services, and we perform regular routine backups. You are solely responsible for all data you transmit. We have no liability to you for any loss or corruption of your data. You hereby waive any right of action against us arising from any such loss or corruption.
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. YOU AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS. You waive any rights or requirements under any applicable laws requiring an original signature or delivery of non-electronic records.

These Legal Terms constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We are not responsible for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision of these Legal Terms is unlawful, void, or unenforceable, that provision is severable from these Legal Terms and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Legal Terms.
